What we do
Our work in this practice group is structured around the records, deadlines, and decisions involved:
- Statutory Operating Authority: Legal authority to operate a commercial office, shop, or service establishment in Maharashtra.
- Mandatory Bank Current Account KYC: Primary commercial premise identity document required by all public and private banks to open current accounts.
- Exemption from Renewal for Small Businesses: Establishments with 0 to 9 employees receive lifetime online Intimation Receipts with zero renewal fees.
- Smooth Municipal Corporation Compliance: Avoids inspection penalties, notices, and closure threats from PMC, PCMC, or local municipal ward offices.
- Facilitates Subsequent Business Registrations: Critical supporting document for GST registration, FSSAI licenses, MSME Udyam, and state government tenders.
- Structured Labor & Employment Standards: Clarifies statutory requirements for working hours, weekly offs, overtime pay, and employee health/safety registers.
How the engagement works
Mandatory under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. Section 6 applies to establishments with 10 or more workers (mandatory Form F Registration Certificate). Section 7 applies to establishments with fewer than 10 workers (mandatory Online Intimation in Form G/Receipt). Operating without registration attracts penalties up to ₹1,00,000 under Section 29.
New Office or Retail Store Launch: Opening any commercial office, clinic, consulting firm, software company, retail outlet, or warehouse in Maharashtra.
Opening Business Bank Current Account: Providing required commercial establishment proof to banks like HDFC, ICICI, SBI, and Axis Bank.
GST Registration Prerequisite: Submitting official address and business premise evidence for GST registration in Maharashtra.
Business Expansion with 10+ Employees: Transitioning from an online intimation to a formal Form F Registration Certificate upon crossing 9 employees.
Change of Business Premise or Address: Amending existing Shop Act records with the local municipal corporation following an office relocation.
Municipal Ward Office Verification: Ensuring full documentary compliance ahead of routine municipal labor department inspections.
Establishment Categorization & Rule Applicability
We analyze employee count, nature of trade/service, and municipal jurisdiction (PMC, PCMC, BMC, or Gram Panchayat) to determine whether Form F Registration or Online Intimation applies.
Document Verification & Signboard Photo Preparation
We review ownership/rental agreements, utility bills, entity registration proofs, and ensure the business signboard photograph displays the Marathi Marathi Devnagari script as mandatorily required by Maharashtra law.
Aaple Sarkar / Municipal Portal Filing
We prepare and submit the digital application on the Maharashtra Government Aaple Sarkar portal and municipal labor authority databases.
General questions
01What is the difference between Shop Act Intimation and Shop Act Registration in Maharashtra?
Under the Maharashtra Shops and Establishments Act, 2017: (1) Establishments with 0 to 9 workers are required only to submit an online "Intimation" (Form G). It is processed automatically, has lifetime validity, and requires no periodic renewal; (2) Establishments with 10 or more workers must obtain a formal "Registration Certificate" (Form F), which is reviewed and approved by the local municipal labor inspector.
02Is it mandatory for the business name board to be in Marathi?
Yes. Under Maharashtra government amendments, every shop and commercial establishment in the state must display its name board in Marathi in the Devnagari script prominently, with font size at least equal to or larger than any other language displayed.
03Can a home-based office or freelance business get a Shop Act license?
Yes. Professionals, consultants, software developers, and home-based businesses operating from residential premises can obtain an online Shop Act Intimation Receipt, provided they furnish property tax receipts, electricity bills, or landlord NOC.
04Does a Shop Act Registration Certificate need annual renewal?
For establishments with 0 to 9 workers (Intimation Receipt), there is no expiry or renewal requirement—it remains valid permanently unless business details change. For establishments with 10 or more workers holding Form F, registration can be obtained for up to 10 years and renewed prior to expiry.
05What documents are required to obtain a Shop Act license in Pune / PCMC?
Documents include: (1) PAN card and Aadhaar card of proprietor/partners/directors; (2) Registered rent agreement and Landlord NOC (or property tax bill/electricity bill if owned); (3) Latest electricity bill of commercial premises; (4) Certificate of Incorporation/Partnership Deed (for non-proprietorship entities); (5) Frontage photograph of shop/office showing name board in Marathi; and (6) List of workers with details (if employing staff).
06What is the penalty for operating a commercial business without a Shop Act license in Maharashtra?
Under Section 29 of the Maharashtra Shops and Establishments Act, 2017, operating without registration or failing to intimate within 30 days of commencement can attract monetary fines ranging from ₹10,000 up to ₹1,00,000. In addition, banks will decline to open current accounts.
07How long does it take to receive the Shop Act certificate?
For businesses with 0 to 9 workers, the online Intimation Receipt is generated almost instantly (within 24 hours) upon correct submission. For establishments with 10 or more workers requiring Form F, municipal department processing typically takes 3 to 7 working days.
